Delaware Administrative Code Title 7, 9000, 9200
The use of drones in Delaware state parks requires a special use permit administered by the Department of Natural Resources and Environmental Control’s Division of Parks and Recreation. This is a requirement even for areas designated for recreational use. There is a $75 administrative fee for the permit.

Delaware Criminal Code Chapter 5, Subchapter 7, Section 1334
- It is illegal to fly a drone over events at which there are more than 1500 people in attendance, over critical infrastructure, or over emergency response operations.
- It is illegal to use a drone to invade the privacy of another person who is on private property in violation of Section 1335 of the criminal code.
- Counties and municipalities may not craft their own laws that regulate the testing or operations of drones.

Delaware State Legislature maintains pre-emption for all rules and regulations that concern recreational and
commercial drone use.

The use of a drone to deliver contraband into a detection facility is considered a Class F Felony or Class A Misdemeanor.
