New Jersey State Drone Laws
These laws apply in the entire state.

New Jersey State Parks

Prohibits all drone operations within lands and waters managed by the State Park Service unless prior permission has been granted by the State Park Service Assistant Director.

Senate Bill 3370

Identifies examples of unlawful drone use that are consistent with federal regulations:

  • operations that endanger life and property
  • operations while under the influence of a mind-altering beverage or substance, obstruction of first responders, or jeopardizing the safety and security of correctional facilities

Drone Laws
These laws apply in some areas.

Local drone laws in New Jersey refer to policies and regulations that are enacted and enforced at the county, city, or town levels.

 

County of Middlesex

Prohibits the use of remotely piloted aircraft any portion of Middlex County Parkland except in areas and during times designated and posted for this purpose by the Director of County Parks and Recreation

Palisades Interstate Park Commission

Prohibits the use of drones and other radio-controlled aircraft in all parks owned or managed by the Commission.

City of Ventnor

  • Prohibits drones from launching or landing on all government and public buildings. Drone flight below 400 feet is also prohibited over such structures.
  • Prohibits drone flight over all city-run parks unless a prior written permission has been granted by the Ventnor City Chief of Police

Wayne Township

Prohibits all drone operations from Wayne Township parks outside of designated areas

Long Beach Township

  • Prohibits launching and landing of drones in the Township.
  • Prohibits drone operations in any airspace within 400 feet of the ground and structures in the Township.
  • Recreational drone use is allowed only within the boundary of a private residential property with the owner’s consent.
  • Commercial drone use by a licensed operator is allowed within the boundary of a private residential property with the owner’s consent. Data collection should also be restricted within the private property. Operations over public streets and property adjacent to the private property is allowed but only within a reasonable amount of time an not within 20 feet of people not involved in the activity.

Borough of Franklin Lakes

Prohibits drones from flying below 400 feet in the Borough over private property, all street and alleys, all Borough buildings and structures, over persons not directly involved in the operations, and between sunrise and sunset.

Borough of Point Pleasant Beach

  • Prohibits launching or landing a drone from or upon any public property except in an emergency.
  • Prohibits flying a drone at less than 400 feet AGL over a public school during school hours without written permission from the school principal or a higher authority. Similarly, capturing images of public school grounds is also forbidden.
  • Prohibits flying a drone below 400 feet AGL in a designated “No Fly Zone” by the Borough administrator. Notices for “No Fly Zones” shall be posted on official Point Pleasant Beach website and public announcement board at the Municipal Complex.
  • Reiterates other UAS flight restrictions that are consistent with federal regulations.

Borough of Allendale

  • Drones are prohibited from flying in any airspace below 400 feet within the Borough. This includes any airspace over residential or commercial zoned area, airspace over any roads and airspace over any government or public buildings, property, or parks within the Borough.
  • Exemptions apply to commercial use of drones during daylight hours within the boundary lines of private property with the property owner’s consent, given that only data of and relating to the property shall be collected.

Roxbury Township

Prohibits the operation, launching, or landing of unmanned aircraft on school grounds unless authorized by the Superintendent or designee.
