Illinois State Drone Laws
These laws apply in the entire state.

House Bill 3906

Prohibits the use of drones in a manner that is intended to enter the space above or surrounding a person’s occupied residence for the purpose of recording a video or invades a person’s reasonable expectation of privacy.

House Bill 1652

It is illegal to use a drone to interfere with another person’s lawful taking of aquatic or wildlife (fishing or hunting).

520 ILCS 5/2.33

It is unlawful to take, pursue, or intentionally harass or disturb any wild birds or mammals by use or aid of any vehicle or unmanned aircraft as defined by the Illinois Aeronautics Act except as permitted by the Code of Federal Regulations. This subjection shall not be used to prevent the use of unmanned aircraft for the inspection of a public utility facility, tower or structure or a mobile service facility by a public utility.

Senate Bill 2937

  • Allows for the use of drones by law enforcement to counter a high risk of terrorist attack, if there is reasonable suspicion of imminent harm to life, to forestall the escape of a suspect or destruction of evidence, to locate a missing person, if a search warrant has been granted, or in the event of a disaster or public emergency.
  • Law enforcement may not acquire information collected by a drone owned by a private third party. This does not prohibit private third parties from voluntarily submitting information acquired by a privately owned drone to law enforcement.

Senate Bill 1587

A law enforcement agency may not use a drone except in conditions detailed in the exemptions. Very similar in essence to SB 2937.

Senate Bill 3291

Prohibits local government units to enact ordinances or resolutions regulating the use of drones. This does not apply to municipalities with a population of 1 million or more inhabitants.

Illinois State Pre-emptions

Illinois State Legislature maintains pre-emption for all rules and regulations that concern recreational and
commercial drone use.

City and County
Drone Laws
These laws apply in some areas.

Local drone laws in Illinois refer to policies and regulations that are enacted and enforced at the county, city, or town levels.

 

McHenry County Conservation District

Prohibits the use of drones or other electric-powered model aircraft within any District property except at areas designated by the Executive Director and according to rules, regulations, and restrictions.

Crystal Lake Park District

Prohibits landing or launching a drone or any other flying device within the Park District except when and where permitted by special Park District Programs or in designated areas.

City of Chicago

Outlines several restrictions for drone flight, many of which mirror federal regulations. Authorizes the seizure of drones used unlawfully by law enforcement.

City of Evanston

Places a moratorium on the use of drones within the City of Evanston until there is reasonable state and federal regulation in place on the use of drone technology.

Village of Schaumburg

Prohibits the operation of a drone within 100 feet of the perimeter of any Village property or Right of Way during a Special Event (public gathering or even held outdoors on Village property with permit issued by the Village), except if operated by or on behalf of the Village for monitoring or documentation.
