House Bill 3906
Prohibits the use of drones in a manner that is intended to enter the space above or surrounding a person’s occupied residence for the purpose of recording a video or invades a person’s reasonable expectation of privacy.
House Bill 1652
It is illegal to use a drone to interfere with another person’s lawful taking of aquatic or wildlife (fishing or hunting).
520 ILCS 5/2.33
It is unlawful to take, pursue, or intentionally harass or disturb any wild birds or mammals by use or aid of any vehicle or unmanned aircraft as defined by the Illinois Aeronautics Act except as permitted by the Code of Federal Regulations. This subjection shall not be used to prevent the use of unmanned aircraft for the inspection of a public utility facility, tower or structure or a mobile service facility by a public utility.
Senate Bill 2937
- Allows for the use of drones by law enforcement to counter a high risk of terrorist attack, if there is reasonable suspicion of imminent harm to life, to forestall the escape of a suspect or destruction of evidence, to locate a missing person, if a search warrant has been granted, or in the event of a disaster or public emergency.
- Law enforcement may not acquire information collected by a drone owned by a private third party. This does not prohibit private third parties from voluntarily submitting information acquired by a privately owned drone to law enforcement.
Senate Bill 1587
A law enforcement agency may not use a drone except in conditions detailed in the exemptions. Very similar in essence to SB 2937.
Senate Bill 3291
Prohibits local government units to enact ordinances or resolutions regulating the use of drones. This does not apply to municipalities with a population of 1 million or more inhabitants.
Illinois State Legislature maintains pre-emption for all rules and regulations that concern recreational and
commercial drone use.
